Twas the Night Before Chirstmas. . Lumberton Edition


I know I said I wouldn't update the blog until December 28, 2011, but a questionable special called meeting is scheduled for tonight @ 6:00 p.m. The meeting was called by Rebecca Hale and Bobby Gibson, you remember them, the two that allegedly signed the paperwork approving the arrest of Mayor Holder. Well, I knew there was supposed to be a meeting, but I was told that the meeting was to grant Jerry Walters approval to take the suburban to Baton Rouge, Louisiana to retrieve a donated tanker, but the agenda that's posted at the library also has an agenda item to hire Timothy Ryan Byrd as Court Administrator at a pay rate of $10.50/hour. Seriously??? Apparently, Jerry Walters was in on the set up. From what I was told, Walters called Mayor Holder asking if he could take the suburban to Baton Rouge to get a tanker. Somehow, Walters managed to get Mayor to tell him to call the other aldermen and see if they could attend a special call meeting to approve his travel, despite telling her that he called Bobby Gibson and Kent Crider already. Knowing that the Mayor would inform him of the code regarding traveling outside the City of Lumberton, I must admit that this was a pretty shrewd move by Walters. But now that the agenda has come out for the meeting, another item was added and that was the intention of the meeting in the first place; to get Byrd hired despite the fact that the minutes from the last board meeting has not been approved (which was probably the reason why the city clerk was working during her week of vacation) and despite the fact that the board has not received the letter detailing the reason of her veto.
In case they missed the first lesson regarding the issue of a veto, I will offer them a refresher: Section 21-3-15, Miss. Code grants a mayor in a code charter municipality (such as Lumberton) authority to veto an ordinance (ordinance, resolution or order). The Attorney General's Opinion No. 2005-0385 explains that the mayor has 10 days after the minutes are approved to file a veto with the city clerk. If the minutes are not approved until the following month, the mayor's veto prior to 10 days after the meeting would be valid.
Stated another way, the 10 days starts when the minutes are presented to you by the city clerk, if you are authorized by a Sec. 21-15-33 board approval to sign the minutes. If you are not authorized to sign the minutes, when the board approves the minutes of the meeting containing the ordinance you are vetoing [Notes: (1) A veto must be in writing, state the objections to the ordinance and be presented to the city clerk within the ten days specified. (2) Sec. 1-3-67 provides for how days are counted; holidays, weekends and days when city hall is closed are counted, except for when they are the tenth day.] In other words, the meeting scheduled for Thursday, December 22, 2011 @ 6:00 p.m. where they are scheduled to vote to hire Timothy Ryan Byrd before approving the minutes and/or overriding the mayor's veto will be an ILLEGAL meeting. Also, they must take into consideration of holding a meeting where the mayor is in jurisdiction. Just something to think about. . I thought we would have a peace at city hall during Christmas, but the Lumberton Board of Aldermen is determined to leave coal in our stockings by breaking yet another law.

  1. Sounds like you need to talk to someone else. Walters had NOTHING to do with the extra item put on the agenda. He was told about it later.
    All he wanted was to be able to go pick up a tanker that was donated to the local fire department. Which Is greatly needed. It is ashame that you are anyone else would take this chance to try to make this into something that it is not. You need to get your facts straight. When Walters ask for the meeting, that was the one and only item that was to be on the agenda.
    Seems like someone is speaking out of turn.

  2. What does this Byrd fellow have on the board? Or could it be that they know he can't get a job anywhere else because other police departments do background checks? The city is already over their budget and they're creating jobs for a person that lost his certification due to his racist behavior but the didn't blink twice when they fired a single mother that has her certification. Gotta love the ignorance of those elected to make these decisions.

  3. So are you speaking for Jerry now? Walter's was aware of what was going on and he knew that was the plan from the beginning. If it's true that he was okayed to go to Baton Rouge by Bobby Gibson and Kent Crider, then why did he bother to call her after he already called the ones he wanted to get an answer from. If he was concerned about the legality of the leaving the city in the truck, he would have called the mayor first, but this was his opportunity to get in on the scheme. I may be wrong, but that's how I feel. Enough of the lip service about how he don't understand why they won't work with the mayor and the first two people he called to get approval to leave in the city truck was Gibson and Crider.

  4. Just when I was beginning to respect Jerry Walters and thought he really wanted to do good for this city. Next, I guess he'll be on here talking about he would vote for Ben Winston as mayor, knowing he's only going to support a white candidate. The sorry mofo can't put out a fire but he's always willing to help get one started. Stop talking out both sides of your mouth and stop pretending you like people that you really detest. Fake bastard.

  6. I agree with the person that asked what does he have on these guys? Why are they so determined to create a job for this person? It's obvious that he can't go back to the Pearl River Sheriff's Department or he would have. According to the minutes, he resigned, so if he resigned in good standing, he would have went back, especially since it's closer to his home. I didn't leave my name, because I'm not ready to get into a debate with Cheryl.

    For someone who doesn't have enough intestinal fortitude to put their name on a post, I've got your stick right here. For your information, i did exactly what the mayor asked me to do. I asked Alderman Crider his opinion, not for his permission. As far as Alderman Gibson goes, he doesn't have the authority to give me permission to do anything. All he done was advise me to call the Mayor, which i did. Ask her yourself. As far as Ben Winston goes, I would vote for him before you would. I don't even know why I bothered to reply to your post because I usually try to keep myself above ignorance but sometimes I have to draw the line somewhere. As far as fighting a house fire, if you think you can do better, get off your sorry ass and prove it. Atleast the volunteers on this fire department care enough about your community to get trained and try. This city needs alot less people with diarrhea of the mouth and alot more that care enough to use their hands. You need to stop assuming things. Makes a bigger ass out of you than you already are.

  9. I don't know why you don't shut down this page. It obvious that the people of Lumberton don't care. I dnow you made some sort of truce with Stephanie and Hobson, but did you forget that they conspired to have you put in jail. Come on man! And why are they so gun-ho about keeping Byrd on the payroll. He must have something on somebody or else they would let him go and if they have money to create jobs, why don't the post it so that a qualified person in Lumberton could get the change to work at city hall. In case you forgot, Stephanie does not want Lumberton people working at city hall and the day they were taking applicatons at the old Movie Star, there were hundreds of Lumbeton resident filling out applications. So, why aren't the people of Lumberton upset about this board creating a job for a resident of Pearl River County when there are residents of Lumberton lookig for jobs?

  11. I know you mentioned that the mayor was in jurisdiction when the meeting was held, but if she was in town, why didn't she attend a meeting that had only two agenda items? She knows more than anyone else that this board and the clerks at city hall do not care about the laws of the State of Mississippi. Why didn't you just go to the meeting and veto the hiring of Byrd and then find some creative way to keep them from overriding your veto. I don't know who's advising Mayor Holder but she needs to either start reading the Informer or getting some advice from him. I was very supportive of the mayor, but it's moves like this that make me wonder if she's the right person for the job. If you're not willing to fight, then please resign and let them have their way since they're doing it anyway.
