Case Dismissed
Last night I attended Lumberton's municipal court and to say that it was entertaining would be an understatement. Last night was trial night and I noticed that no one testifying was required to place their hands on a bible and swear to tell the truth, the whole truth and nothing but the truth. So, that should give you an indication of the type of court that is taking place in Lumberton. Before court started, there were one or two individuals causing ruckus in the foyer. The lawyers that were present looked at one another and the people sitting in court just looked at one another in disbelief; especially since there were at least 7 police officers in the foyer as well. In my opinion, the things that were being said (threats, etc.) should have been considered an act of disorderly conduct, but apparently, the Lumberton Police Department can only arrest a person for disorderly conduct in the dark of night. After the judge finally showed up, court started at a glacial pace. The case I was waiting to hear was finally called. Due to a lack of evidence, and the fact that the person filing the charges was a no-show, the case against Johnathan Hosey was dropped. Hosey was charged with stalking, a very difficult case to prove in the first place, but it seems that the person that filed the charges was coaxed into filing the charges; otherwise, she would have been there to present her case. Ironically, the people she had called as witnesses even said they knew nothing about the case. I don't know what led the person to file the charges, but something needs to be done about people that file frivolous charges against another person and don't show up to testify. Can Hosey get the money back he put up for bail? Probably not. Hosey was exonerated, but Hobson rushed to have his photo placed in The Jailer. Will Hobson submit a letter informing The Jailer that the case against Hosey was dismissed? Probably not. The case against Hosey fell apart because the case lacked merit and the woman that filed the charges had no intention of testifying to a lie. Unfortunately, Hosey and his family have been tarnished by this incident and the judicial system has no way to unring that bell. Hopefully, there is a way for Hosey to restore his name and move forward from this event.
